Maintaining trust in the motor vehicle sales industry relies on more than resolving disputes, it requires ongoing accountability. When the Motor Vehicle Disputes Tribunal (MVDT) issues an order, most traders comply promptly. But what happens when they don’t? That’s where the Registrar’s responsibilities come into play.
Our role in the process
Monitoring Compliance
We keep a record when a trader does not follow a Tribunal order. This helps us stay transparent and spot patterns of non-compliance.
Applying the MVSA
If a trader fails to comply with 2 or more Tribunal orders within a 10-year period, they become a “banned person” under the Motor Vehicle Sales Act (MVSA). At that point, we act to enforce the restrictions outlined in the Act.
We do not enforce Tribunal orders
We do not enforce MVDT decisions. Our role is limited to recording non-compliance and applying the MVSA provisions when necessary.
